PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF SITE USE CAREFULLY AS THEY APPLY TO ALL USAGE OF ROCKYSCIGARS.COM. These Terms & Conditions may be modified at any time.

If you do not agree with these Terms & Conditions, do not partake in this Site or its features.

Site access and activity are subject to the following terms and conditions and other applicable law. Your use implies agreement to these policies.

Legal
Rocky’s Cigars requires individuals that purchase products must be of legal age and eligible in their respective state/locality including the purchase tobacco and tobacco accessories. The purchaser assumes all responsibility for any taxes, fines, fees, or requirements brought forth by any purchases from our business.

SHIPPING POLICY

Shipping/Sales

We DO NOT sell tobacco or tobacco-related products to any persons under the age of 21. By purchasing from Rocky’s Cigars, you are acknowledging that you comply with all applicable tobacco laws in your jurisdiction. Misrepresenting yourself is strictly prohibited, and your use of this Site and its features is entirely at your own risk.

We CANNOT sell or ship tobacco or tobacco-related products to the following states due to state tobacco regulations: CA, CO, HI, MD, ME, SD, UT, VT, & WA.

Please note that all shipments require an adult (21 years or older) signature.

We charge the following rates for all ground packages:

$0-$149.99 = $9.99 flat rate
$150.00 or more= Free Ground Shipping (On select items)
Any customers wanting rush delivery must pay additional charges for any packages requested to be sent Next Day, 2^nd day Air, or 3-day select via USPS.
Any Value Pipe Tobacco purchases 0-9Lbs have an $8.99 shipping and handling charge.
Any Value Pipe Tobacco purchases greater than 9 lbs have a $19.99 shipping and handling charge.

All merchandise leaves our facility in perfect condition. If any received item is damaged or lost during transit, please call us immediately. The outer packaging must be saved for USPS verification; otherwise, we cannot guarantee that USPS will reimburse us for damages. We will reship all items as soon as possible and handle any claim with USPS for you.

HOW LONG DOES IT TAKE AFTER I ORDER?
Orders are processed during our business hours and shipped promptly the next business day, unless it is on a Friday; in that case, your order will ship on Monday morning, since our shipping department is closed on Saturdays and Sundays. Remember this includes holidays as well.*See the UPS transit map for the approximate package arrival date.

State Restrictions

California
While we require all purchasers to be over 21 years of age, California’s Senate Bill 39 requires us to: 

• Confirm your delivery of tobacco products by telephone call after 5PM (PT) the day prior to shipment
• Obtain the signature of a person 21 years of age or order before completing the delivery

Note, in order to comply with this restriction, we are unable to ship to a PO Box or offer certain shipping methods to California.

Colorado

Shipments to Colorado residents are subject to Total Retail Delivery Fees of $0.27 per sale. For additional details, go to: Retail Delivery Fee | Department of Revenue - Taxation

Hawaii 

Due to Hawaii State Regulations, we do not ship any products to Hawaii addresses.

Maine

Due to Maine State Regulations, we do not ship the following products to Maine addresses:

• Cigars with Homogenized/HTL Wrappers
• Small Cigars (Weighing 3lb per 1000 or less)
• Pipe Tobacco

Maryland

Due to Maryland State Regulations, we do not ship the following products to Maryland addresses:
• Cigars with Homogenized/HTL Wrappers
• Small Cigars (Weighing 3lb per 1000 or less)

Utah 

Due to Utah State Regulations, we do not ship any products to Utah addresses.

Vermont

Due to Vermont State Regulations, we do not ship the following products to Vermont addresses:

• Small Cigars (Weighing 4.5lb per 1000 or less)

Washington

Due to Washington State regulations, we cannot ship the following products to Washington addresses:

• Small Cigars (Weighing 3lb per 1000 or less)
• Pipe Tobacco

Personal Information

All orders must contain accurate personal contact information. Rocky’s Cigars is not held responsible for the inability to fulfill an order or contact a customer due to incorrect, or deficient information provided at the time of the order or inquiry.

Inventory/Availability
Rocky’s makes every attempt to provide accurate website inventory for orders to be placed. In the event there is an out of stock, or a we are unable to fill the order completely we will contact you at the email or phone provided. Returns are handled on a case by case basis; Rocky’s reserves the right to impose a 20% re-stocking fee for returns without defect or due shipping error.

Typographical Errors
Rocky’s Cigars is not responsible for typographical errors. When a product is mistakenly listed at an incorrect price, Rockyscigars.com reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. In the event credit card has been charged for the purchase we shall issue a credit to your credit card account in the amount of the incorrect price.

Rockyscigars.com Use of Site
Rocky’s may provide the ability for users to create user generated content. All forms of harassment are forbidden. This includes but is not limited to harassment in the form of e-mail, chat, or posts of any kind. Obscene or abusive language is forbidden. Falsely Impersonating others, including a Rockyscigars.com employee or representative, as well as other site members or visitors on the site is prohibited. It is strictly prohibited to upload distribute, or in any way or method publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. You may not upload commercial content on the site or use the site to solicit others to join or become members of any other commercial online service or other organization.

COUPON & DISCOUNT CODES

How do coupon or discount codes work on Rocky’s Cigars?
Coupon codes can be applied to most products on our website. However, they do not apply to categories labeled “No promotional codes or offers available with these items”, rare and limited releases, closeout or sale items (including certain samplers), custom samplers, gift cards (in-store or online), or ticketed events.

Codes can be entered during checkout or in your shopping cart. Please note that only one code may be used per order. Some brands may also be excluded in accordance with their manufacturers’ policies.

Rocky’s Cigars reserves the right to refuse or cancel any order that does not meet brand requirements or qualifies for promotional exclusions.
